Terms & Conditions

These terms and conditions shall apply to your purchase of tickets for Santa’s Grotto at South Downs Nurseries and tickets for Santa's Enchanted Forest at Old Barn Garden Centre, operated by The Budding Foundation, charity no. 1155335.

Please read these terms and conditions carefully, particularly the section regarding cancelling or amending your tickets. By ticking the ‘I agree to the terms and conditions’ box, you are confirming that you are happy to be legally bound by these terms and conditions.


If you do not agree to these terms and conditions, you should not tick the ‘I agree to the terms and conditions’ and you should not continue with the purchase of tickets for Santa’s Grotto at South Downs Nurseries or Santa's Enchanted Forest at Old Barn Garden Centre.

1. Santa’s Grotto and Santa's Enchanted Forest
1.1 Santa’s Grotto operates at South Downs Nurseries, Brighton Road, Hassocks, West Sussex, BN6 9LY. It is operated by The Budding Foundation, charity no. 1155335. All proceeds from ticket sales are used by the charity to fund charitable projects.

Santa's Enchanted Forest operates at Old Barn Garden Centre, A24 Dial Post, Horsham, West Sussex, RH13 8NR. It is operated by The Budding Foundation, charity no. 1155335. All proceeds from ticket sales are used by the charity to fund charitable projects.

1.2 Admission to Santa’s Grotto or Santa's Enchanted Forest is only accepted upon receipt of a valid ticket, purchased online via www.thebuddingfoundation.co.uk.

1.3 Your ticket must be presented in printed form or viewable on a mobile device. The Budding Foundation reserve the right to request proof of identity before allowing admission to Santa’s Grotto or Santa's Enchanted Forest. 

 

1.4 You must arrive at least TEN (10) minutes in advance of your allocated time slot. We will use our reasonable endeavours to admit latecomers, but late admission cannot be guaranteed.
1.5 You shall be responsible at all times for ensuring the correct and safe supervision of all children in your group.


2. Purchasing Your Tickets
2.1 Tickets to Santa’s Grotto and Santa's Enchanted Forest are available to purchase online through www.thebuddingfoundation.co.uk and are subject to availability.
2.2 Payments for tickets online shall be made using the online payment facility which is provided by PayPal. We do not store your payment card details.
2.3 Your ticket is only valid for the date and time specified on your ticket.
2.4 Unlawful resale (or attempted unlawful resale) of a ticket will result in the cancellation of that ticket without refund or other compensation.
2.5 We will not be responsible for any tickets that are lost or stolen. You will be responsible to ensure that you have a valid ticket ready to be inspected upon your arrival at Santa’s Grotto or Santa's Enchanted Forest.


3. Cancelling or Amending Your Tickets
3.1 Tickets to the Santa’s Grotto and Santa's Enchanted Forest are non-refundable.
3.2 You may be able to change your allocated time slot up to 48 hours prior to your allocated time slot, subject to availability, by notifying us by any of the following means:

3.3 The Budding Foundation may cancel or reschedule your visit to Santa’s Grotto or Santa's Enchanted Forest at any time at our absolute discretion. If a suitable timeslot cannot be found, we will then offer you a full refund.

3.4 In the event of changes to government guidance due to covid-19 that require us to cancel this event, your ticket fees will be treated as a donation to The Budding Foundation Charity and you will not receive a refund.

 

4. Photography
4.1 You are permitted to take your own photographs during your visit to Santa’s Grotto on the strict condition that all photographs consist of your family members only. It is important that other guest’s privacy is respected at all times during your visit.
4.2 By purchasing a ticket and visiting Santa’s Grotto or Santa's Enchanted Forest, you are granting us the right to take photographs of your visit and edit all resulting materials for publicity in any manner we deem fit so long as it is in connection with Santa’s Grotto or Santa's Enchanted Forest. For example, we may include photographs of your visit on The Budding Foundation or Tates of Sussex social media channels and any public relations materials.



5. Your Privacy
5.1 By providing your personal information to us when you purchase your ticket, you consent to us processing your data in accordance with these terms and our privacy policy.
5.2 The personal information you provide to us when you purchase your ticket is held by Digitickets, a third party supplier that we use to provide the online platform your tickets are booked through. Details of their privacy policy can be seen here: http://www.digitickets.co.uk/privacy-policy
5.3 Your personal information is collected and stored in accordance with the Data Protection Act 1998.

 

6. Liability
6.1 Our liability for any losses you and/or any of your guests may suffer as a result of us breaching these Terms and Conditions or for any breach of any statutory duty or negligence or otherwise is strictly limited to the total purchase price of your tickets to Santa’s Grotto or Santa's Enchanted Forest.
6.2 To the maximum extent permitted by law, neither we (The Budding Foundation) nor any of our volunteers or Trustees, or Tates of Pyecombe Ltd. directors, employees or other representatives will be liable for any of the following losses or damage (howsoever arising and whether such losses were foreseeable or not).
a. loss of data;
b. loss of profit;
c. loss of revenue;
d. loss of business or opportunity;
e. loss of goodwill;
f. disappointment or emotional distress; and/or
g. any indirect, consequential or special loss;
arising in connection with Santa’s Grotto or Santa's Enchanted Forest, or the provision of our services to you.
6.3 Nothing in these Terms and Conditions shall exclude or in any way limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any liability which cannot be excluded or limited by law.

 

7. Events Outside Our Control
7.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions that is caused by any event outside our reasonable control (“Force Majeure Event”).
7.2 A Force Majeure Event (without limitation) includes the following:
a. Strikes, lock-outs or other industrial action;
b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
d. Impossibility of the use of public or private telecommunications networks;
e. The acts, decrees, legislation, regulations or restrictions of any government; and/or
f. High winds or any other extreme weather conditions which necessitate the closure of the Location for the safety of our volunteers, staff and customers.
7.3 Our performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to provide a suitable alternative date on which you can enjoy Santa’s Grotto or Santa's Enchanted Forest.

8. Law and Jurisdiction
8.1 These Terms and Conditions and the terms of our Privacy Policy shall be governed by and construed in accordance with the laws of England. You accept that any dispute under these Terms and Conditions and/or our Privacy Policy shall be subject to the exclusive jurisdiction of the English courts to which you submit.

 

9. Complaints
We accept that, despite every effort being made to ensure you have a trouble free, enjoyable family experience, things may occasionally go wrong. If you have a complaint you must inform our volunteers immediately. They will attempt to resolve the problem as soon as possible. If, however, an acceptable solution is not found and you wish to take the matter further, please email us (admin@thebuddingfoundation.co.uk) detailing in full the nature of the complaint, wherever reasonably practicable within 7 days of your visit. This will allow us to investigate your complaint fully.
